Landscaping company fined for alleged violations of the state Illegal Immigration Reform Act
MOUNT PLEASANT -- Pleasant Places, Inc. landscaping faces a $24,000 state fine for alleged violations of the South Carolina Illegal Immigration Reform Act, officials said Thursday. Since July 1, the state Office of Immigration Worker Compliance has cited 16 businesses for violations of the new law after conducting audits at 550 firms. Of those cited, only Pleasant Places, Inc. has failed to correct alleged violations, said Jim Knight, communications director for the state Department of Labor, Licensing and Regulation. The business is accused of failing to verify the legal status of 24 workers hired after July 1, he said. The maximum penalty per violation is $1,000. On Aug. 11, Pleasant Places, Inc., located on Long Point Road, was fined $4,250 for violations of the immigrant worker law, according to the immigration office.

There are many organizations defending companies like Pleasent Places as heros of poor people, "just trying to work." It seams to me that these organizations are deeply involved in a conspirasy to promote illegal employment practices and other frauds. The ease with which these organizations move from promoting unauthorized entry to promotion of felony frauds of various statutes both federal and state is erry. I understand empathy for one's brothers and I understand free speech, but promoting and condoning criminal acts is unamerican and illegal. Passion for a cause does not authorise promotion of criminality, and prosicuters should deal with these groups.

tha answer to that would be no....you cannot deduct a traffic fine so this is about the same and wouldn't be a legitimate deduction...if they did it would most likely trigger an audit and then they could really crawl up their butts so to speak. If you remember they never got Al Capone on his crimes, they got him on tax evasion....

Taxes and Fees You Cannot Deduct

Many federal, state, and local government taxes are not deductible because they do not fall within the categories discussed earlier. Other taxes and fees, such as federal income taxes, are not deductible because the tax law specifically prohibits a deduction for them. See Table 22-1.

Taxes and fees that are generally not deductible include the following items.

*

Employment taxes. This includes social security, Medicare, and railroad retirement taxes withheld from your pay. However, one-half of self-employment tax you pay is deductible. In addition, the social security and other employment taxes you pay on the wages of a household worker may be included in medical expenses that you can deduct or child care expenses that allow you to claim the child and dependent care credit. For more information, see chapters 21 and 32.
*

Estate, inheritance, legacy, or succession taxes. However, you can deduct the estate tax attributable to income in respect of a decedent if you, as a beneficiary, must include that income in your gross income. In that case, deduct the estate tax as a miscellaneous deduction that is not subject to the 2%-of-adjusted-gross-
income limit. For more information, see Publication 559.
*

Federal income taxes. This includes income taxes withheld from your pay.
*

Fines and penalties. You cannot deduct fines and penalties paid to a government for violation of any law, including related amounts forfeited as collateral deposits.
*

Gift taxes.
*

License fees. You cannot deduct license fees for personal purposes (such as marriage, driver's, and dog license fees).
*

Per capita taxes. You cannot deduct state or local per capita taxes.

Many taxes and fees other than those listed above are also nondeductible, unless they are ordinary and necessary expenses of a business or income producing activity. For other nondeductible items, see Real Estate-Related Items You Cannot Deduct , earlier.

Speaking of "the cost of doing business", I wonder if the IRS allows these companies who have been fined to write off that "loss"? If they do, or don't really question it when the company files, then what good does it do? That $24,000 fine being used as a write-off is a hell of a deal for any small or semi-small business. I would have to assume they do write it off, and no wonder this creep keeps them employed, it offsets payroll costs even further!

I agree the fines should be more, but it's better than nothing. -In Ca. it's pretty much, "Don't ask, Don't tell"...for Illegal Aliens, and 95% of the time they're reported it's like "Well, we don't care either". -I'd give So. Carolina 2 Kudos, one for passing their version, of an illegal hiring law, and two, for actually enforcing it. -Hope they make some tax dollars off it.

Slap companies on the wrist for hiring 'Illegal Immigrants' encourages more 'Illegals' to South Carolina. If this is considered the toughest immigration law in the nation we're in deep do-do.

Why is it OK to keep existing illegal Hispanic workers on the payroll? It's been against federal law to hire 'Illegal Immigrants' for many years. Sounds like 'Amnesty' to me.

It's cheapest to hire legal people, dont you think..?
From tiredofit - 06 Nov 2009 @ 06:37 am
more like $25K per illegal employed and loss of the business license for 2 years would be more effective...otherwise to them its the cost of doing business....make it cost ineffective!!!

and to boot make the CEO/PRES/CFO/HR Director of the company stand on a street corner 8 hours a day for 2 weeks with signs saying "WE HIRED ILLEGAL ALIENS TO TAKE YOUR JOBS"...let them take the wrath of the unemployed and those who are tired of paying for these invaders!!!
From Anonyma - 06 Nov 2009 @ 04:38 am
$10,000 a violation would get these willing-slave-users butts in gear and the illegals off the payroll.
